Screening

Our outbound email service provider screens unusual activity within their system. Screening includes monitoring excessive usage that may include the following instances: multiple credit card refusals, email campaign information (email address used, number of messages being sent, specific words used in the subject or content) and IP address of the account holder. In each instance the account may be investigated for illegitimate activity.

Privacy

A recipient of a Black Duck Marketing email will be able to see their email address. No other information on any other recipient is accessible regardless of the number of messages sent.

CAUBE Member

Our outbound email service provider is a member of the Coalition Against Unsolicited Bulk Email (CAUBE) to help in the effort against spammers and their unwanted email.

Complaint Handling

As part of our overall service we provide email recipients with a means to report spam complaints for further investigation. On receiving a complaint we abide by the following procedure:

1.

We will preserve the content of any complaint you send us if we believe we have the legal requirement to do so.

2.

The complaint is investigated to validate its origin, content and scope.

3.

Where a complaint can be validated we will:
a. Flag the member account as having a complaint against it and the details of that complaint recorded where we believe we have the legal requirement to do so; and or
b. Unsubscribe the complainant from the account where we believe we have the legal right to do so.

4.

Legal action may also be initiated in accordance with our Terms and Conditions of Use.

5.

If false complaints are made Black Duck Marketing reserves the right to commence legal action to recover any damages caused from such complaints.

6.

Where the complaint has uncovered a breakdown in policy, procedure or expectations by you, Black Duck Marketing will audit and, where necessary, amend any policy, procedure or customer interaction.

7.

You may receive a follow-up email to inform you of any action that may have been taken.

Black Duck Marketing encourages persons who believe they have been sent spam by a member using our services, to contact the sender directly to ensure expedient removal from any mailing list they may have you on.
