Refund PolicyBlack Duck Marketing provides a 12-month email marketing campaign strategy for hair and beauty salons. In conducting these campaigns on behalf of its clients, Black Duck Marketing relies on the client to provide the following:
Black Duck Marketing accepts no responsibility whatsoever if incorrect recipient lists are supplied or incorrect text is selected or used by the client, and will make no refund if a campaign is conducted using information supplied by the client that later proves to be incorrect through no fault of Black Duck Marketing. Black Duck Marketing in no way accepts responsibility for proofing of campaign content. Any errors in text, of any nature, even if seemingly obvious will not be corrected by Black Duck Marketing. It is the sole responsibility of the client to ensure that content is as they wish it to be broadcast. The client enters into an agreement with Black Duck Marketing to conduct a package of email marketing campaigns over a 12-month period on its behalf. There are a number of packages available. Each package will contain a defined number of elements that are typical of the campaigns used within the salon industry. Marketing programmes purchased from Black Duck Marketing begin from the date of the first campaign (Usually the ‘Database permission and cleanup’ campaign) and extend for one year unless other specific arrangements have been entered into in special circumstances. The programmes contain specific elements as detailed on the website. It is the responsibility of the purchaser to provide the content and recipient lists for the completion of each element. If the purchaser does not schedule campaigns or provide recipient lists or text and image content then any unused elements existing at the end of the 12-month period lapse. Black Duck Marketing will not give a refund of any monies paid for the programme or be bound in any way to provide the services once the 12-month date has passed. Furthermore, no unused elements of any programme can be carried forward if another 12-month programme is purchased. Each programme is a separate entity and no variation is possible. If for some reason one or more elements of the programme as purchased by the client are properly selected and scheduled by the client, and correct recipient lists are sent to Black Duck Marketing and Black Duck Marketing fails to conduct the campaign on behalf of the client, then Black Duck Marketing will offer another campaign at no cost to the client, or will give a pro rata refund to the client, whichever the client chooses. In the event that Black Duck Marketing terminates a client membership, as it is entitled to do under the terms and conditions accepted by the client, a refund of any monies tendered in advance will be made less the costs of any campaigns undertaken to that point plus a reasonable administration fee.
